Oleg Kozachuk, Acting General Director of Khmelnytskoblenerho, shared a post on Facebook in which he explained the recent events at JSC Khmelnytskoblenerho.
"I was silent for a long time about the situation around Khmelnytskoblenergo [Khmelnytsk region electricity distribution system operator, DSO] and me personally, but today officials from the State Property Fund of Ukraine (SPF) have crossed significant boundaries. When I was on vacation on April 28th the SPF, through a secret illegitimate and illegal composition of the supervisory board, dismissed me from the post of Acting General Director of Khmelnytskoblenergo and appointed a new acting CEO. Therefore, today, after a regular meeting of shareholders, I held a press conference and explained to the media and society my position and vision of this situation. All the main legal details and nuances are described in the attached article and voiced at a press conference. Here I want to convey only my main messages:
- I have never held onto, do not hold onto and will not hold onto any position. Therefore, I will not allow anyone to pretend this is what is happening now. Khmelnytskoblenergo is no exception, in spite the fact that this is my first employer after finishing university, my first work experience (2002-2006 as an inspector, site manager, deputy director of energy Letychiv REM, head of quality management in the management staff) and I have spent 5 years in management positions and acting CEO after returning to the company (2015-2020).
- Over the years, this is not just my belief but is evidenced in all the relevant data, the team has achieved the best indicators and results in the history of the company. We informed you about all the results both on the website and on Facebook. I can proudly say that this is the best company and the best team among all state regional power companies for sure, and possibly private ones.
- The actions of SPF officials are illegal and violate many norms of current legislation. The SPF and the company's supervisory board have the right to make any LEGAL DECISIONS. And we have fulfilled, are fulfilling and will fulfil all of them. But we will not accept illegality. Moreover, these moves are conducted behind the scenes, opaquely, and NOT in the interests of the STATE, but in the interests of a certain group of people with unfortunately known results in advance. Want to dismiss someone? Dismiss them, but do so in accordance with the LAW. Which means do it openly and transparently. And the approval of the new acting director, (I emphasize “acting” and not the official General Director because that was done to bypass the transparent competition requirements for such appointments) of the Cabinet of Prime Minister Goncharuk at its final meeting on February 26, the SPF first told me about it in early April. So the circus with the supervisory board and my dismissal is then painted in even more detail. To make an illegal decision to dismiss me, AND not let me know, are separate masterpieces. By the way, I would like to point out that I officially won a genuine competition for the position of General Director of Khmelnytskoblenerho back in 2016, and I have an official notification from the SPFU about this. That's another story.
- I hope that the President and the Prime Minister will understand this situation and the right decision will be made. I have always fought, I fight and I will fight for transparency, openness and legality. I will defend my honour and dignity, including in the courts. And I will do it publicly, transparently and exclusively within the current legislation! I invite SPF officials to do the same.
